UK mediator Henry Brown, co-author of ADR Principles and Practice, (published by Sweet & Maxwell) and co-founder of the Family Mediators Association in England explains the process of family mediation. He describes it as a facilitative process in which a couple whose relationship has broken down engage the assistance of an impartial mediator to help them deal with the issues arising on that breakdown. This may involve dealing with arrangements for separation or divorce, child custody and contact (access/visitation), housing and property issues, spouse and child maintenance and any other issues that the couple may wish to resolve.

The mediator helps the couple to deal with all of these issues by negotiated agreement without adjudication. The mediator has no authority to make any decisions for the couple, but uses certain procedures, techniques and skills to assist them in arriving at their own decisions. Family mediation is invariably interest-based. Parties are helped to explore and enhance their mutual interests in a confidential and supportive environment.

A mediator can also help parties to resolve other kinds of conflict by negotiated agreement, including for example inheritance or family business disputes.

All mediators in the mediation group are experienced family lawyers who have had specialised mediation training. Many have been trained by Henry Brown and Felicity White (Lady Blair), who co-founded the Family Mediators Association in England and who were responsible for establishing the mediation training and practice programme of the UK Solicitors Family Law Association.
